rented from landlord a year. Beginning of August we warned her we were looking for a home and would move if we found one. Agreed to resign a lease for six months as we were probably going to find a home. Well, we did. Close date is October 25. the landlord wont even help in trying to find a new tenant but her assistant has actively helped us and shown the apartment. we have deposit plus pet deposit riding on this place and when it comes down to it we will pay our mortgage before we pay the rotten landlord. You wouldnt believe that this could even be a dispute if you knew how much real estate the money hungry lawyer owns. Can i get out of a rental lease for buying a home?
Unfortunately, your story is not unusual.
You committed to a lease and it is up to the landlord if they refund your deposits. They are not obligated to. You did the right thing by saying you were house hunting, but will your landlord do the right thing and refund your money? Doesn't sound like it.Can i get out of a rental lease for buying a home?
It doesn't matter what you told him or how much money he has. You still signed a new lease. Why didn't you ask for a month to month lease incase you found a house to purchase???
Bottom line is...You signed a legally binding contract!!!! He could actually ask you to pay out the entire lease if he wanted to or sue you for the money, which would probably affect your house purchase.
I would talk with him and be nice. You will never get anywhere by calling him money hungry except sued, out of a place to live and probably unable to purchase the house.
Why did you sign a six month lease if you were planning to move before that? Did you not read your lease? She's not rotten, she's following the terms that YOU agreed to and signed a legal document confirming your agreement.
sublet the apartment and in fact charge an extra 100 dollars to the tenant.
Depends on what your lease contract says.
If there is a provision for early termination, then you have a chance. If not, then your are stuck.
It appears that you are actively seeking someone to rent the apartment in your absence, this may be incentive for the landlord to release you from your contract/lease. You may ultimately be held responsible for the period of time that the apartment is vacant until someone rents it.
Congratulations on the home purchase and good luck.
Nope. And the landlord does not have any legal ot moral reasons to help you. a lease is a contract. Your ethics are questionable on this. Dirty rotten landlord has every right to sue and will win easily particularly if a lawyer.
