You can absolutely break any lease at any time. You cannot be forced to live in one place or another. However, you understand that there are costs in early termination of the contract. You can assist the landlord to keep those costs low, and perhaps work something out. first of all, you need a valid reason to break it...and moving to a better apartment is not going to fly in his book. i would talk to him, but he will most likely slap you with the full ';lease break penalty'; specified in the lease. only way that i could see it not going that way is if you find someone to rent your aparement (your landlord would have to approve this person, but it would save him advertising fees). it also depends on how much time that you have left on the lease.
Replacing a tenant is time consuming and not cheap.
If you find a replacement tenant who can pass the credit checks that you did, by doing the advertising and initial interviews to make sure they are employed and not druggies AND if you offer to pay a small penalty you might have a chance of getting out of the lease.
Moving to a ';better residence'; is not a valid reason to break your contract. Read your lease provisions.
The best way would be to find him a new tenant. . . :)
