My apartment complex did not provide enough parking space to allow residents to have guest. To solve this problem. they are restricting outside guest from the parking lot between 9pm and 7am. , and threatening to tow violators. Outside of the complex gate are six parking spaces. This is a large complex, so that is not even adequate for a small complex. Management is asking that we all come in and sign an addendum to our lease, and pick up a parking tag, so they can enforce this new policy. Once again, is this legal?Is it legal to add a restriction to a rental lease after it has been signed?
Generally, any lease has a section in it that states the owner can make any changes to your lease with notice. Some require you to sign, others only require that the owner present you with the addendum.
If you have the first option, and don't sign the addendum, they can evict you with a minimum amount of notice. For instance, in LA County, you can be evicted in 3 days unless you live in protected areas (ie, Santa Monica, etc). The second means they can tow you if you don't go pick up that parking tag, and you'd be responsible for all the fines, etc that go along with them towing you.

Well, before I read the entire question i was going to say they could yes with an addendum.
In most states the landlords cannot change the terms of the lease without your written consent, but if your lease period has expired, (you are month to month) they can change the terms of your lease such as raising your rent, they just have to give you 10 days notice (it varies state by state).
If your lease is in effect and has an end date that is in the future, they cannot change the terms except when your lease is up for renewal. You do not have to sign the addendum.
If I were you and my lease still had a few months on it, I would negotiate with them by asking for a rent reduction, or an extension of your lease at the current rent in exchange for your signature.
If you sign an addendum to your lease yes it is perfectly legal. If they did that without anyone signing anything it would be illegal.
If you sign the addendum, then the new policy is binding, It will just become part of your lease. If you feel you have been wronged in anyway, PLEASE seek legal help before you sign the Addendum.. It should not cost all that much.. And Might save you a towing bill or two.. Good luck..

In order for the amendment agreement to be valid, it must be signed by all of the parties listed in the original agreement.
