if u have a lease agreement u can only evict for non payment not bc their late. if u accept their funds this still constitutes as payment. so u must refuse to accept their rent if it is late. a 3 day notice is a pay or quit notice for unpaid rent. then u must give them 30 days eviction. then u take that paper and file a court date in ur county court office. after the judge orders and eviction u give it to the sheriff who comes to the proerty andphyscially removes them.
Why the heck did you put his name on the lease if he doesn't own the house?
If you did not form a company with him and he is not acting as a property manager for pay, then I don't think his name being on that lease means anything because he's not an owner. You might want to call a lawyer and check with him/her just to be sure.
