My lease expired and I am on a month-to-month rental agreement. I live in LA under rent control can they enforce the original terms of the lease? If you are on a month-to-month do I only have to give 30 days notice to vacate? In the original lease terms I had to give 60 days written notice but that expired in March 2007 and I automatically moved to the month-to-month agreement. Please let me know. Yes, if you go to a month-to-month rental, your move out notice drops to 30 days. The law says you have to give notice of the same length as your payment--in other words, if you rented a place and paid weekly, you would only be required to give a seven day notice. In your case you now pay monthly, so a thirty day notice is all that is required. If you give said thirty day notice, do it in writing and if you are charged any penalty, simply utter the phrase ';small claims court'; and you could very well see a ';waiver of charges'; by the landlord/property manager. Do everything in writing and landlords hate small claims--its just you, them and a judge and inexpensive to file. Stick up for your rights--and no, i'm not a renters' advocate--i'm a landlord. A month to month agreement is by definition a 30 day agreement unless there is some quirky CA law that requires something different. Consult your lease because there may be a provision for 60 days in the event that you go into a month to month arrangement.
