I'm in a rental lease of a house (with 2 room mates) until August. It's my name on the contract, and the landlord is probably willing to break it in April, but not any sooner. Since I want to talk to a recruiter and join in January, would that force him to break the lease? Would I have to wait until I get shipped to basic training? Would I have to wait until I transferred to somewhere else, or what if I stayed in Utah (where I live)Will joining the military break my rental lease?
Once you have orders to ship out for basic training give a copy to the landlord. He is required by law to release you from your lease, no matter how many more months are left. Your orders have to ship you out of the area, not simply because you joined.
If you are talking about National Guard this only applies if you have to leave, not your 2 weeks of training. Will joining the military break my rental lease?
Like it or not, the answer to your question is in your lease.
Often leases include clauses that allow you to break your lease for such things as unforeseen job transfers and this applies to the military too.
The bottom line is that your best bet is being upfront and honest with your landlord about the coming changes in your situation such that when it is time to go everyone will be prepared (including your roommates).
If you talk to a recruiter and enlist in January, it will probably be at least 3-6 months before you leave. Worry about it then.
Legally, this should be grounds for breaking your lease though.
btw, thanks for looking into Serving!
WHEN YOU JOIN THE ARMY YOU WILL BE LEGALLY PROTECTED UNDER THE JANAP PROTECTION. ASK YOUR RECRUITER ABOUT THIS. IF YOU JOIN YOUR LAND LORD SHOULD BE PATRIOTIC ENOUGH TO BREAK THE LEASE IF NOT DO IT ANY WAY
Once you get your formal orders you can break the lease without penalty.
Joining the military has no bearing on your lease. Your still obligated.
