In florida if a rental lease is up how do i evict a tenent?

they haven't paid rent in 3 months and their lease is up can i just change the locks and kick them out or do i have to follow the eviction rules like they were still living thereIn florida if a rental lease is up how do i evict a tenent?

You have to issue them a 3 day pay or quit notice.


Since they probably will not pay, then you need to go to the court and file eviction papers, get a court date, and then move along from there. The judge will award you the eviction, give you a date they need to be out, that is when you can go accompanied by the Sheriff to give them an hour to remove their crap, or you can move it...and then you can change locks and do whatever.





Do it legally, or you might find yourself on the wrong end of the law.





Also, why didn't you evict them or issue pay or quit notices before they went 3 mos without paying rent?
NO! Just changing the locks is ILLEGAL!! You must properly evict them.





You can serve a 3 day pay or quite since they have so much unpaid rent. When they have not paid the rent in full or moved out with in those 3 days then file the eviction with the court on the 4th day.





EDIT: You do not need to go through the extra expense of a lawyer. An eviction for non-payment is pretty simple.
